Thematic Interpretation of the Concept of the Limit of Jarimah Sariqah According to the Qurthubi in Surah Al-Maidah Verse 38
Abstract
This study discusses the concept of hadjarimah sariqah (the law of cutting off the hand for thieves) which is often misunderstood as a cruel and inhumane punishment. This misunderstanding arises due to a lack of understanding of the legal basis, namely Surah Al-Maidah verse 38. The purpose of this research is to understand the meaning of the punishment of cutting off the hand in the verse in depth through the interpretation of scholars and mufasir. The author uses the Qurthubi Tafsir as the main source because it is famous for its extensive discussion of Islamic law, including the issue of sariqah. The research method used is library research with the book Al-Jami'li Ahkam Al-Qur'an wa Al-Mubayyin five Tadhammanah min As-Sunnah wa Ay Al-Furqan as the primary data source. The conclusion of this study shows that the punishment of cutting off the hands in Islam has a strong basis and strict conditions to ensure justice and humanity. A proper understanding of the concept of hada jarimah sariqah based on the tafsir of trusted scholars such as Al-Qurthubi can help correct misunderstandings and increase people's understanding of Islamic law.
