Abstract

The main objectives of this paper are the research of the limits of the will autonomy of the spouses regarding their relations property, the research of the possibility of applying the general norms of the family code on the marriage contract and further, the investigation of the way of coordination of the general rules of the civil code in the contract of matrimonial property regimes. In this paper, a comparative analysis of the Family Code of Italian, French and other legislations was made. Through this comparison, the level of approach is evidenced. Attention has been paid to the classification of marriage contracts and the analysis of "atypical" marriage contracts. The paper is also focused on the analysis of general and specific limitations, to which the contractual freedom of the spouses is subject.
