Artificial Intelligence Between the Requirements of Public Administration and the Guarantees of Constitutional Rights (A Study within the Framework of Public Law)
Abstract
Our current era is witnessing a fundamental shift in the nature of public administration work, driven by the technological boom in the field of artificial intelligence. This transformation has led to increasing overlap between modern technologies, such as artificial intelligence, and the field of public administration. These overlaps raise important questions about how to harness the potential of artificial intelligence to improve the efficiency of services and decision-making, while ensuring the protection of individual freedoms and constitutional rights from infringement. Therefore, this study primarily aims to explore this delicate balance and propose a regulatory and constitutional framework that ensures the use of artificial intelligence technologies in public administration in a manner characterized by transparency, justice, and respect for human rights. This study relies on a descriptive and analytical approach to examine legal and constitutional texts, and a comparative approach to review the experiences of some countries in regulating the use of artificial intelligence in public administration. The results reveal numerous legal and constitutional challenges to the application of artificial intelligence systems in the field of public administration. The study also proposes an integrated regulatory and constitutional framework to address these challenges and ensure the responsible use of these technologies in the field of public administration.
